We advised an elderly Canadian client (originally from Jamaica) who arrived in the UK to visit his sister who is a British Citizen. He has been diagnosed with dementia and other medical conditions. He has no other close family members in Jamaica or Canada and was living in a care home.
Our client and his sister approached us to apply to extend his visitor’s visa. As a Canadian, he was allowed to stay in the UK for a maximum of 6 months, no more, unless he can prove to have exceptional circumstances.
We met with the clients and carefully built a compelling case supported with documentary and medical evidence to show the client’s vulnerability and risks associated with him potentially having to live alone in Canada if forced to return in circumstances where he has a sister in the UK who is willing and able to care for him and manage his health conditions.
Our client also had to demonstrate the ability for the Applicant to be cared for without recourse to public funds and also satisfy the case worker that his presence in the UK is conducive to the public good and that he is not a threat to himself or others.
The Application was meticulously prepared and was successful with grant of leave for 30 months which can be renewed prior to expiration of the visa, much to the delight and relief of the family.
