The seven steps of Litigation
Pre-action – Before filing a claim, you can explore settlement options and attempt to resolve the dispute through informal discussions. We’ll help you gather evidence and assess your position.
Pleadings – This is where you start the claim, each party clearly outlines their arguments and legal grounds for their position.
Directions – The court manages the progression of your case, setting deadlines and ensures both parties are prepared for the next steps heading towards resolution.
Trial – Both parties present their evidence and arguments before a judge or jury, who then reach a decision on what they’ve heard.
Appeals (Judicial Review) – If there has been a legal error, an appeal can be made to a higher court for review and reconsideration.
Judgement – The judge issues their final ruling which determines the outcome of the case and the rights and obligations of each party.
Costs – A formal assessment of costs is made.The successful party may be able to claim some legal costs from the unsuccessful party.
